INTRODUCTION

The Online Shop at NOT JUST A LABEL is a service of NOT JUST A LABEL Ltd. ("NOT JUST A LABEL"/"NJAL"/"We"/"our"/"us") provided solely for your personal use for the sale of clothing, accessories and other Items ("Items").

Access to and use of this Website and the products and services available through this Website are subject to the following terms, conditions and notices.

We have taken great care to ensure that the Items on our website are presented as accurately as possible. However colour clarity will depend upon your own personal monitor and we therefore cannot guarantee that the colour of the actual Item is absolutely accurate. Before placing an order please read through these Terms.

To be eligible to purchase Items on this Website you must:

  1. Be the holder of a valid debit/credit card.
  2. Warrant that the personal information which you are required to provide when you place an order is true, accurate and current in all respects.

You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use.

By using this site you agree to comply with, and be bound by, these Terms.

We may from time to time change these Terms at our sole discretion. By using this Website after any such change(s), you agree to comply with, and be bound by, the Terms as changed.

  1. MAKING A PURCHASE

    When you order an Item from NOT JUST A LABEL you are offering to buy it for the price stated, subject to these Terms.

    You will be guided through the process of placing an order by a series of instructions on the Website. You place your order for Items from the Website by clicking on the [CONFIRM YOUR ORDER] button at the end of the on-line order process. Once you have placed your order, we will send you an email acknowledging the exact details of your order. Unless we have notified you that we do not accept your order or you have cancelled your order in accordance with the Returns policy set out in section 11 below, our acceptance of your order and the completion of the contract between you and us will take place when you receive an email from us confirming the Items ordered by you.

    Our acceptance of your order will be deemed complete and received by you at the time and date of sending of the email, which time and date is specified on the email. The deemed time and date of receipt by you shall apply regardless of whether, for reasons outside our control, you have not received that email.     We may not accept your order if:

    1. An item you have ordered is out of stock,
    2. We are unable to obtain authorisation for your payment or
    3. If we identify a product or pricing error. We reserve the right to reject any offer to purchase by you at any time and at our sole discretion.

    If we are unable to fulfil your order following our order acknowledgement, we will contact you by email or telephone advising you of this. See the Returns policy set out in section 11 below. We will try to keep our Website as up to date as reasonably possible but cannot guarantee that any particular Item will always be available. If we can't supply any Item we will release the funds being held in your account for the purchase.

  2. PRICING

    All prices indicated for Items sold directly by NJAL and available from our showroom are inclusive of VAT (where applicable, prices for Items for which designers use NJAL as a transaction platform are inclusive of the respective taxes of the country the designer is based in, however only if the designer is VAT. registered) at the current rate and are quoted in Pounds Sterling with an approximate indication of the price in USD, EUR and JPY based on a daily updated exchange rate. Please note that these are an approximate conversion and that each currency is subject to a general fluctuation depending on the exchange rate at the time it was entered. We will update these currencies on a regular basis but may not reflect the daily exchange rate.

  3. COUPON DISCOUNTS

    Discounts may in our complete discretion from time to time be offered to selected customers. Discount privileges will be subject to monthly review. Discount privileges may be withdrawn at any time in relation to any Order which has not been acknowledged.

  4. PAYMENT

    Payment can be made by using all major credit and debit cards through the SagePay HSBC Secure ePayments tool. Payment will be debited and cleared from your account upon dispatch of your order by NJAL. You confirm that the credit/debit card that is being used is yours or that you have been specifically authorised by the owner of the credit/debit card to use it. All credit/debit card holders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses to authorise payment to NJAL, we will not be liable for any delay or non-delivery.

    We take all reasonable care to make our Site secure. NJAL does not store your credit card details on our systems, however all other details will be fully encrypted and only used to process the order which you have initiated. To help ensure that your shopping experience is safe, simple and secure NJAL uses Secure Socket Layer (SSL) technology provided by Digicert Inc., the industry standard in transferring information to process your orders.

    Furthermore, we will take all reasonable care, in so far as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorised access to any data you provide when accessing or ordering from the Site.

  5. CREDIT CARDS

    Your credit card company may undertake an additional security check to confirm it is you making the order.

    All credit/debit cardholders are subject to validation checks and authorisation by the card issuer. If the issuer of your payment card refuses, or subsequently refuses to, or does not, for any reason, authorise payment to us, we will not be liable for any delay or non-delivery.

    We and our designers will retain the legal ownership of the Items until full payment has been made by you and such payment has been received by us. Legal ownership of the Items will immediately revert to us if we refund any such payment to you. Risk in the Items will pass to you on delivery to you.

  6. SHIPPING

    We and our designers aim to deliver your chosen items to the place and person of your choice, in perfect condition and in the shortest possible time. For Items stored at the NJAL Showroom, UK and overseas orders are shipped by UPS for a speedy delivery. All purchases are insured by us while in transit until it is delivered to you. If you wish to track your parcel, please email us and we will either track your shipment for you or email you a tracking number which can be used on the UPS.

    Designers selling directly from their studios provide the same method of delivery, which is subject to a thorough quality control process by NJAL in order to ensure complete customer satisfaction.

    Please order from NOT JUST A LABEL with enough lead-time to prevent any loss or disappointment resulting from the delivery time as we cannot be responsible for this. Delivery time is normally between 2 and 5 working days depending on when your order is processed and the location you require the order to be shipped to.

    If your order cannot be delivered within the timeframe specified at the time the order is placed we will notify you and try to rectify the situation as quickly as is practically possible. All new orders are deemed separate and each is treated individually.

  7. DISPATCH

    Please note that we and our designers aim to dispatch all orders within 48 hours. We operate Monday to Friday and not on public holidays. Estimated delivery times are to be used as a guide only and commence from the date of dispatch, NJAL and its designers are not responsible for any delays caused by any local customs clearance processes.

  8. TAX & DUTIES

    If you are ordering goods for delivery outside of the EU or purchase items from a designer based outside your country or trading zone, please note that your purchase may be subject to import duties and taxes, which are levied once the goods reach the country of destination. Any such charges levied in relation to customs clearance must be borne by you. It is accepted by you that NJAL or its designers have no control over additional charges in relation to customs clearance. NJAL recommends that you check with your local customs officials or post office for more information regarding importation taxes/duties that may be applicable to your online order.

  9. INSURANCE

    NJAL and its designers insure each purchase during the time it is in transit until it is delivered to your specified delivery address. We require a signature for any goods delivered, at which point responsibility for your purchased goods passes to you. If you have specified a recipient who is not you for delivery purposes (for example as a gift) then you accept that evidence of a signature by them (or at that delivery address) is evidence of delivery and fulfilment by NJAL and transfer of responsibility in the same way.

  10. FORCE MAJEURE

    NJAL and its designers shall have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond its reasonable control.

  11. REFUNDS & RETURNS

    NJAL wants to ensure your complete satisfaction. For online purchases, we will accept Items not worn, used or damaged for a full refund as set out below.

    Customer satisfaction is our top priority, and as such we handle each query on an individual basis to the best of our ability. While we hope that you are delighted with your order, if you are not perfectly satisfied with your goods we will happily offer you a full refund or exchange.

    We must stress that in order to receive a refund or exchange, the item(s) must be unworn and in perfect condition, with all labels attached and in the original packaging. Please follow the steps below:

    Simply return the item or items in their original condition within 14 days of receipt to NJAL if they were delivered from our showroom, or alternatively to the respective designer. We will issue a full refund (excluding original delivery charge) on receipt, or exchange the item for a different size / colour if preferred and available. Please note:

    1. Please notifiy us and the respective designer (in case you received an item delivered by the designer) of your intentions to return the Item within 48 hours of delivery and apply for a RMC (Return Merchandise Code) code.
    2. Once provided with the RMA code, please seek to return items within 14 days of the date of your return request. Returns outside these timeframes may be accepted at the discretion of NJAL and the respective designer, and depending on the circumstances may only be refunded as a store credit.
    3. The item is your responsibility until it reaches us. For your own protection, we recommend that you send the parcel using a delivery service that insures you for the value of the goods.
    4. The cost of returning the item to us is your responsibility.

    All successfully returned items will be only credited to the account used to originally purchase the items, less any taxes, import duties or shipping charges incurred. With exchanges, your new item(s) will be shipped to you as soon as we receive your returning package and any additional payment which is required.

    PLEASE NOTE: New and unused means that there are no marks on the item or any wear on the tags. We do not sell used items and will not accept any item with any indication that it was used. In such cases, the item will be returned to the purchaser. NJAL and its designers are not responsible for any item that is not returned in the manner set forth above.

    Shoes: All shoes must be tried on a carpeted surface until you are certain you are keeping them. Shoes should be returned unmarked and in their original, undamaged shoe box as this is considered part of the product. Shoes that are returned without a box, in a damaged box or with marked soles may not be accepted, and may be sent back to the customer.

    Intimate Apparel: Briefs, swimming costumes and bikini bottoms should be tried on over underwear, without removing the protective adhesive strip. Returns may not be accepted if this strip has been removed or if items are soiled, and may be sent back to the customer.

    Please be aware that items which are made by order are not refundable. International customs duties and sales taxes are not refunded for any shipments.

  12. GIFT RETURNS

    If you have received an item from NOT JUST A LABEL as a gift you can exchange it for another item of the same value or more provided you pay the cost difference and the additional shipping, taxes, and import duties, and any additional charges which may incur as a result of exchange.

  13. COPYRIGHT AND TRADE MARKS

    All content available on the Website, including, but not limited to, text, graphics, logos, button, icons, images, audio clips, data compilations, and software, and the compilation thereof (the "Content") is the property of NJAL, our designers, our partners or our licensors, and is protected by UK and international copyright laws.

    The trade marks, logos, and service marks displayed on the Website (collectively, the "Trade Marks") are the registered and unregistered marks of NJAL, our designers, our licensors or our partners, in the UK and other countries, and are protected by UK and international trade mark laws. All or any other trade marks not owned by us, our affiliates, our partners or our licensors that appear on the Website are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us.

    Neither the Content, the Trade Marks, nor any other portion of the Website may be used, reproduced, duplicated, copied, sold, resold, accessed, modified, or otherwise exploited, in full or in part, for any purpose without our prior written consent.

  14. ENTIRE AGREEMENT

    These terms and conditions, together with the current NJAL website prices, delivery details and NJAL contact details, set out the whole of our agreement relating to the supply of the goods to you by NOT JUST A LABEL. These terms and conditions cannot be varied except in writing signed by a director of NJAL.

  15. GOVERNING LAW

    Your use of this Website and any purchase by you of any Item from NOT JUST A LABEL shall be governed by English law and you hereto submit to the exclusive jurisdiction of the English courts.

  16. PRIVACY POLICY

    We will treat all your personal details as confidential and we will only disclose this information in the circumstances set out below. We will keep it on a secure server and we will comply with UK Data Protection legislation in relation to the use of your personal data. When you register on this Website, or make a purchase we will ask you to input and will collect personal details from you such as your name, e-mail address, billing address, telephone number. We may also collect, and our third party providers may collect, information about where you are on the internet (e.g. the URL you came from, IP address, domain types like .co.uk and .com), your browser type, the country and telephone area code where your computer is located, the pages of our website that were viewed during your visit, any advertisements you may have clicked on, and any search terms that you entered on our Website. We confirm that any personal details which you provide to us (or which are available on public registers) and any user information, from which we can identify you, is held in accordance with the registration we have with the Information Commissioner's Office.

    We use your information only for the following purposes:

    We will not release your personal details, however you should be aware that if we are requested by the police or any other regulatory or government authority investigating suspected illegal activities to provide your personal details and /or user information, we are entitled do so.
